Terms of service
I found the remaining seller information in Shopify: 2622595 ONTARIO INC, operating as The Whole Home Studio. The version below uses that company name, your saved business contact details, and your existing refund policy.
It retains your template’s section structure while incorporating the revisions we discussed, particularly to shipping risk, product warranties, liability, and customer submissions. Pasted markdown Pasted markdown Pasted markdown This is a tailored drafting aid, not a lawyer-reviewed legal opinion; an Ontario lawyer’s review would be particularly useful for the liability provisions.
Copy from “Terms of Service” through the end of Section 25 into Shopify → Settings → Policies → Terms of service. After saving, link that policy in your footer using the Policies link type, as Shopify specifies for the Google & YouTube channel. I have not published or changed anything in your store. Terms of Service
Last updated: October 5, 2026
Overview
The Whole Home Studio is operated by 2622595 ONTARIO INC, an Ontario corporation carrying on business as The Whole Home Studio. In these Terms, “we,” “us,” and “our” refer to that corporation.
We operate this website and online store, including its content, features, tools, products, and services, collectively referred to as the “Services.” Our online store is powered by Shopify.
These Terms of Service, together with the policies expressly incorporated into them, explain the terms on which you may use the Services and purchase products from us. Please read them before placing an order. Our Privacy Policy explains how personal information is handled, and our Refund Policy explains our returns and refunds process.
By using the Services or placing an order, you agree to these Terms to the extent an agreement is formed under applicable law. If you do not agree, please do not place an order or continue using the Services.
Nothing in these Terms excludes, restricts, or modifies any consumer right, warranty, condition, or remedy that cannot lawfully be excluded. Where these Terms conflict with mandatory law, that law governs.
Section 1 — Access and account
To place an order, you must have the legal capacity to enter into a binding agreement. If you purchase on behalf of another person or an organization, you must have authority to do so.
You agree to provide accurate, current, and complete information needed to process your purchase, including your contact details, delivery address, and payment information. You must be authorized to use the payment method you provide.
If you create an account, take reasonable steps to protect your login credentials and notify us promptly if you suspect unauthorized access. You may not sell or transfer your account to another person without our permission.
Section 2 — Our products
We aim to describe and show our products accurately, including their materials, dimensions, appearance, functionality, and included components.
Colours and lighting effects may appear different depending on screen settings, photography, and the lighting in your space. Our printing and finishing processes may also produce minor variations in surface texture and finish between individual items. These variations do not limit your rights if a product is defective, damaged, or materially different from its description.
The applicable product listing identifies what is included with your purchase. Unless expressly stated, furniture, decorative objects, and other styling accessories shown in photographs are not included.
Please use products as described and follow the care and safety instructions supplied with them. Use only compatible power supplies and light sources that meet the product’s stated requirements. Contact us before use if you are unsure about compatibility or believe a product is damaged.
We may update descriptions, introduce or discontinue products, and limit quantities or delivery destinations. Changes to a listing do not retrospectively alter the product description or commitments applicable to an order already accepted.
Section 3 — Orders
When you submit an order, you offer to purchase the products selected at checkout. We accept your order when we send an order confirmation accepting your purchase. A payment authorization alone does not constitute acceptance.
Before accepting an order, we may decline it for reasonable reasons, including unavailable stock, an unsupported delivery destination, a material listing error, or suspected fraud or unauthorized payment.
If we decline an order or cannot fulfil an accepted order, we will notify you using the contact information provided and refund any amounts paid for the unfulfilled portion, including applicable taxes and delivery charges. We will not substitute a materially different product or increase the amount charged without your agreement.
Please review your order before submitting it. To request a cancellation or change, contact hello@thewholehomestudio.ca as soon as possible. We will try to accommodate requests before shipment. Once an order has shipped, our Refund Policy applies, together with any rights you have under applicable law.
Our Refund Policy forms part of these Terms. It provides a 30-day period from delivery to request an eligible return, with no restocking fee. For change-of-mind returns, customers are responsible for return shipping, and original shipping charges, if any, are not refundable. Different arrangements apply to damaged, defective, or incorrect items.
The 30-day return window does not limit statutory rights or remedies that may apply beyond that period.
Purchases may be made for personal use, gifts, or legitimate business purposes. Please contact us to discuss any separate wholesale, trade, or resale arrangement.
Section 4 — Prices and billing
Prices are in Canadian dollars unless another currency is clearly identified.
Applicable taxes and delivery charges are disclosed before you complete checkout. Any additional charges that we require you to pay must be disclosed and agreed to as required by law.
Prices, promotions, and product availability may change for future purchases. Subject to the handling of errors described in Section 12 and applicable law, the price agreed for an accepted order will not be increased without your consent.
Promotions may have separate conditions, such as eligibility requirements, minimum purchase amounts, expiry dates, or restrictions on combining offers. Those conditions apply to the relevant promotion but do not override mandatory consumer rights.
Please keep your contact and billing information current so we can process transactions and communicate about your order.
Section 5 — Shipping and delivery
Supported delivery destinations, available shipping options, charges, and any stated processing or delivery estimates are provided on the website or at checkout.
Delivery times are estimates unless we expressly agree otherwise. Carrier delays and events outside our reasonable control may affect delivery. We will communicate material delays when we become aware of them. Describing a delivery time as an estimate does not remove any cancellation or refund right provided by law.
For shipping we arrange, the risk of loss or damage remains with us until delivery to you or a person you authorize to receive the order. Handing a parcel to a carrier does not, by itself, transfer that risk to you.
If your order appears lost, arrives damaged, or contains an incorrect item, contact hello@thewholehomestudio.ca. We will investigate and arrange an appropriate replacement or refund, consistent with our Refund Policy and applicable law.
Please provide an accurate delivery address and contact us promptly about any errors. We will discuss any additional costs associated with a requested delivery change before charging them.
Section 6 — Intellectual property
Website content, branding, photographs, graphics, videos, and product designs may belong to us, our licensors, or other rights holders. Rights in third-party designs remain with their respective owners. Selling a product does not mean that we created or exclusively own its underlying design.
You may use the website to learn about our products, make purchases, and manage your orders. You may retain copies of product information, order records, and policies for your own reference and share links to publicly available pages.
Unless permitted by law or authorized by the relevant rights holder, you may not copy or commercially exploit protected website content, product designs, or branding.
Buying a physical product does not transfer copyright, design rights, or a licence to reproduce that product. Nothing in these Terms limits uses permitted by applicable intellectual property law.
Shopify’s trademarks and other third-party trademarks belong to their respective owners.
Section 7 — Optional tools
The Services may include optional tools provided by third parties. Separate terms may apply to those tools, and their availability or operation may depend on the provider.
We do not promise that every optional tool will always be available or error-free. Please review any applicable provider terms before using a tool.
Using a third-party tool does not remove our responsibilities as the seller or limit your rights concerning a purchase from us.
Section 8 — Third-party links
Our website may link to third-party websites or content for information or convenience. Unless expressly stated, a link does not constitute an endorsement.
Third-party websites operate under their own terms and privacy practices. We do not control their content or operation.
This section does not exclude any responsibility we have under applicable law or transfer responsibility for products we sell to another party.
Section 9 — Relationship with Shopify
Shopify provides the ecommerce platform that enables us to operate our online store. Purchases from The Whole Home Studio are made directly with 2622595 ONTARIO INC, carrying on business as The Whole Home Studio, not with Shopify.
We are responsible for our products, fulfilment, customer service, and the seller obligations associated with your purchase. Shopify is not the seller or manufacturer of our products.
Your use of separate Shopify services may also be governed by Shopify’s own terms and policies. Nothing in these Terms excludes liability or limits rights against any party where doing so would be prohibited by applicable law.
Section 10 — Privacy policy
Our Privacy Policy explains how we collect, use, disclose, and otherwise handle personal information.
Because our store is hosted by Shopify, Shopify also processes information in connection with operating the platform and providing its services. Shopify’s practices are described in its Consumer Privacy Policy.
Information may be processed outside your province or country, as described in the applicable privacy policies.
Accepting these Terms does not, by itself, constitute consent to receive marketing communications where separate consent is required.
Section 11 — Feedback and customer submissions
You retain ownership of reviews, photographs, comments, and other content you submit, subject to any rights held by others.
When you intentionally submit content for public display on our website, you give us a non-exclusive, royalty-free permission to display and reproduce it for that purpose, including reasonable formatting changes that do not misrepresent its meaning.
We will seek separate permission before using private customer-support messages or privately submitted photographs in advertising. Private correspondence and personal information remain subject to our Privacy Policy.
Reviews must reflect genuine experience. You must have the rights necessary to submit the content and disclose relevant commercial relationships or incentives where required.
We may remove content that is fraudulent, unlawful, abusive, spam, infringes another person’s rights, or exposes personal information without permission. We will not remove a review merely because it is negative.
Submitting feedback does not create an entitlement to payment unless we have separately agreed otherwise.
Section 12 — Errors, inaccuracies, and omissions
We may correct typographical errors, inaccurate information, or omissions on the website, including errors concerning prices, descriptions, availability, or delivery estimates.
If a material error affects an order, we will contact you to explain it. We will not charge a higher price or supply a materially different product without your agreement.
Where cancellation is permitted by law and an affected order is cancelled, we will refund the amounts paid for the cancelled portion, including applicable taxes and delivery charges.
This section does not give us a right to disregard an accepted agreement or any statutory consumer remedy.
Section 13 — Prohibited uses
You may use the Services only for lawful purposes.
You must not use the Services to commit fraud, make unauthorized purchases, impersonate another person, knowingly submit misleading information, infringe intellectual property rights, harass or threaten others, or distribute unlawful material.
You must not introduce malicious code, harvest another person’s personal information without authorization, send spam, attempt to access restricted systems, bypass security controls, or interfere with the normal operation of the Services.
These restrictions do not prohibit honest reviews, criticism, good-faith complaints, accessibility tools, or the exercise of legal rights.
Automated access is addressed in Section 14.
Section 14 — Agents and automated access
Customers may use accessibility tools and authorized shopping assistants to access the Services, provided their use is lawful, respects applicable access restrictions, and does not disrupt the website.
Search engines and approved integrations may access publicly available content in accordance with applicable technical access instructions and permissions.
Automated tools must not bypass security controls, access private information without authorization, impersonate others, make unauthorized purchases, or place an unreasonable load on the Services.
If you authorize an agent or shopping assistant to act for you, you remain responsible for instructions and transactions that you validly authorize, subject to applicable law. This does not make you responsible for unauthorized transactions.
We may reasonably restrict abusive or unauthorized automated access.
Section 15 — Suspension and termination
We may restrict or suspend access to the Services where reasonably necessary to address fraud, security risks, unlawful conduct, or a material breach of these Terms. We will provide notice where appropriate and legally required.
Suspension or termination does not remove your rights concerning an existing purchase, cancel a refund we owe, or relieve us of obligations relating to an accepted order.
You remain responsible only for amounts lawfully owed.
Provisions that are intended to continue after use of the Services ends—including provisions concerning intellectual property, privacy, existing orders, and dispute resolution—will continue to apply to the extent permitted by law.
Section 16 — Website availability and product warranties
We take reasonable steps to operate the website, but we do not promise that access to the website or optional online tools will always be uninterrupted, timely, or error-free.
General editorial content, such as styling ideas, is provided for information. It does not replace the specifications or instructions for a particular product.
Website-availability limitations do not apply as a blanket “as-is” disclaimer for the products we sell.
Our product descriptions, any express warranties or commitments we provide, our Refund Policy, and all warranties, conditions, and remedies required by applicable law remain effective.
No statement in these Terms limits rights concerning product quality, fitness, durability, safety, or conformity with a description where those rights cannot lawfully be excluded.
Section 17 — Limitation of liability
To the extent permitted by law, we will not be responsible for indirect or consequential business losses, such as lost business profits or business interruption, arising solely from temporary unavailability of the website or optional online tools.
This limitation concerns website-related losses. It does not restrict remedies concerning defective, damaged, or misdescribed products, physical injury or property damage caused by our products, refunds owed, or any liability that cannot lawfully be excluded.
Nothing in these Terms excludes liability for fraud or wilful misconduct.
Any limitation in these Terms applies only to the extent that it is lawful and enforceable in the circumstances. You retain all mandatory consumer rights and remedies.
Section 18 — Indemnification
To the extent permitted by law, you agree to reimburse us for reasonable losses and legal costs arising from a third-party claim directly caused by your fraudulent or deliberately unlawful use of the Services, or your knowing infringement of another party’s rights through content you submit.
This obligation does not arise merely because you browse the website, purchase or use a product lawfully, submit an honest review, or make a good-faith complaint. It does not cover losses caused by our own conduct or the conduct of persons for whom we are responsible.
We will notify you of any relevant claim and will not agree to a settlement imposing an obligation on you without your consent.
Section 19 — Severability
If a provision of these Terms is found unlawful or unenforceable, it will be ineffective to the extent required by law. The remaining provisions will continue to apply where they can do so lawfully.
An unenforceable provision will not be used to reduce a consumer protection that applies to your transaction.
Section 20 — Waiver and entire agreement
A failure or delay by either party to enforce a right does not, by itself, waive that right.
These Terms, the policies expressly incorporated into them, the applicable product description, your order confirmation, and any additional terms expressly agreed for your purchase form the agreement relating to that purchase.
Nothing in this section excludes a representation, warranty, commitment, or remedy that forms part of the agreement or is protected by law.
For return procedures and eligibility, the applicable Refund Policy governs, subject to mandatory consumer rights. The Privacy Policy governs the handling of personal information.
Any ambiguity will be interpreted in accordance with applicable law, including rules that require an interpretation favourable to the consumer.
Section 21 — Assignment
Neither party may transfer contractual obligations in a way that unlawfully reduces the other party’s rights.
We may transfer the business and related contractual obligations to a successor, provided your rights under existing orders are preserved and any legally required notice is given.
This section does not prevent you from giving a purchased physical product as a gift or exercising rights that are transferable by law.
Section 22 — Governing law and disputes
These Terms are governed by the laws of Ontario and the federal laws of Canada applicable there, subject to any mandatory protections that apply to you under another jurisdiction’s laws.
Please contact hello@thewholehomestudio.ca about a concern so we can try to resolve it. Contacting us is not a prerequisite to exercising a statutory remedy.
Nothing in these Terms requires mandatory arbitration, waives a right to participate in a class proceeding, or requires a consumer to bring a claim in Ontario where applicable law permits a claim elsewhere.
Section 23 — Headings
Headings are included for convenience and do not change the meaning of these Terms.
Section 24 — Changes to these Terms
We may update these Terms from time to time and will identify the revised date at the top of this page. We will provide notice of material changes where required by law.
Changes apply prospectively. An existing purchase remains governed by the terms and policies applicable when the order was placed, unless you agree to a lawful change or a change is required by law.
Continued use of the website does not, by itself, alter the terms of an earlier purchase or waive an existing right.
You may save or print these Terms for your records.
